06/219 - DECLARATION OF INTEREST ON ANY MATTERS OF BUSINESS

Councillor Powell declared a prejudicial interest in agenda item 06/224e.

 

06/220 - TO RECEIVE APOLOGIES FOR ABSENCE

All Councillors being present there were no apologies.

 

06/221 - TO CONFIRM THE MINUTES OF THE COUNCIL MEETING HELD ON 16 OCTOBER 2006

The minutes of the Parish Council meeting held on 16 October 2006, having been circulated, were approved and signed.

 

06/222 - CLERK'S REPORT

(a)   Progress on the Section 30 agreement for Broad Lane (Min. 06/204a)

The Clerk and Chairman had completed the form.  The Clerk asked for clarification of the area of land that was envisaged as coming under Section 30.  It was agreed that Bob Missin of the City Council be consulted before the form was sent to the City Council. (Action Clerk).

 

(b)   Progress on replacing the litter bin by the Millfield Lane bus stop (Min. 06/204b)

The Clerk reported that he had received a note from the City Council to say that the litter bin has been ordered and is to be installed within the next two weeks.

 

(c)    Progress on acquiring the CYC Lighting schedule (Min. 06/204c)

The schedule has been received and a copy given to each Councillor.

 

(d)   Progress on public footpath response (Min. 06/212)

There had been no response from the City Council response on this item

(d)    To consider items for inclusion in the 2007-08 budget

Items suggested for inclusion in next year's budget were a survey of the trees behind Riverside Walk, five sessions of skate boarding, £1,000 to the Youth Club and new seats on the Moat Fields.  The suggested items will be included in the budget paper to be presented at the January Parish Council meeting.

(e)      To discuss a request from the Poppleton Community Trust for funding in the next financial year

Councillor Powell vacated the Chair and left the room at this point.  Vice-Chairman Councillor Tomlinson now took the Chair.  Councillor Tomlinson had stated that he had taken advice from the City Council's Monitoring Officer and did not consider that he had a prejudicial or even a personal interest in the subject of the Community Centre as he was merely the Parish Council's appointed observer at the meetings. 

The Councillors discussed an eight-page document from the Trust that had been circulated prior to the meeting.  It was observed that the Trustees had not specified a sum of money they would like to receive from the Parish Council and that they should be asked to submit a figure for consideration (Action Clerk).  It was also agreed that the subject of funding for the Community Trust should be the aired with the Councillors of Upper Poppleton at a Joint Parish Council meeting to be held on Monday 11 December.  A decision on funding was deferred until the January Parish Council meeting.

 

06/225 - PLANNING APPLICATIONS

(a)   To consider the following planning applications

The Clerk had circulated a detailed list of current outstanding planning applications prior to the meeting. 

Consideration was given to the following new applications: (Councillor Bradley declared a personal interest on application 06/02200/GRG3).

 

Ref:  06/02079/ADV - 4 no. 12-metre high flag poles at Devries Honda, Great North Way by Devries Honda.

 

We object to the application as there is already sufficient advertising in this area.  Four 12-metre high flagpoles could further distract drivers around the busy ring road roundabout.  It is recognised as an accident black spot and that there are shunts between vehicles on a regular basis.

 

Ref:  06/02108/GRG3 - Change of use of agricultural land adjacent to existing sports field and move boundary fence to include new land at OS Field 6031, Millfield Lane by City of York Council as Custodian trustee of Poppleton Comms.

Ref:  06/02125/FUL - Two pitched roof dormers to front over existing garage at Carlton House, Ferrymans Walk by Mr & Mrs Grassby.

Ref:  06/02129/FUL - Part two part three-storey side extension and three pitched roof dormers to rear (revised scheme) at 3 Church Lane by Mr & Mrs S Mann.

 

This application has already appeared as 06/01340/FUL and was refused by the Planning Authority.  Any alterations to the drawings have been only superficial.  Our comments are unchanged.

 

We object to the application in that the site is within the Nether Poppleton Conservation Area.  The proposed extension does nothing to enhance or even support the Conservation Area status.  The proposed roof dormers on the rear of the property will provide the opportunity for overlooking into the rear of gardens of No. 5 Church Lane and Well House, No. 8 Fox Garth.

 

Ref:  06/02200/GRG3 - Erection of two-storey school building with associated car parking, playing fields, tennis courts and all-weather pitch at proposed Manor Church of England School site, Millfield Lane by York Diocesan Board of Finance.

 

No objections but recommend that the proposed 30mph limit outside the school be a 20mph limit.

 

Ref:  06/02233/FUL - Single-storey rear extension and vehicle access and car parking, new rooflights at Dodsworth Hall, Millfield Lane by Honeypots (Dodsworth Hall) Ltd.

Ref:  06/02374/FUL - Change of use to B2 (general industrial) use including motor vehicle repairs and MOT testing at London Ebor Developments plc, Millfield Business Centre, Millfield Lane by Mr M Blenkinsop.

Ref:  06/02429/FUL - Dormer window to front, single-storey extension to side and rear including dormer window at Hazeldene, 5 Hillcrest Avenue by Mr R Birkin.

(b)   To note Local Authority Planning Decisions

It was noted that the Local Planning Authority had approved the following three applications:

Ref:  06/00518/OUTM - Variation of condition 1 of planning permission 99/01777/OUT (for proposed mixed use development comprising cycle and car park to proposed rail halt, office/light industry/research and developments (B1), general industrial (B2) and storage or distribution (B8) uses) extend the time to the period for the submission of reserved matters application until 01.04.2013 by White Rose Development Enterprises Ltd at York Business Park, Millfield Lane.

Ref:  06/01587/FUL - Part two-storey, part single-storey pitched roof side/rear extension at 52 Allerton Drive by P Bootham.

Ref:  06/01898/FUL - Single-storey pitched roof extension to front elevation at 24 Allerton Drive by Mr & Mrs J Butler.

 

It was noted that the Local Planning Authority had refused the following three applications:

Ref:  06/01536/FUL - Single-storey extension to North side elevation.  Pitched roof one and two-storey extension to South side elevation.  Pitched roof double garage to front at 1 Poppleton Hall Gardens by Chris Swift & Sonia Snowden.

Ref:  06/01933/FUL - Two-storey pitched roof side extension and single storey porch extension to front at 66 Allerton Drive by Mrs S Jackson.

Ref:  06/02038/FUL - First floor pitched roof side extension at 19 Nursery Road by Caroline and Steven Crosby.

 

The Chairman reported that two recent planning applications had referred to previous applications of which the Parish Council had no record.  It was agreed that these anomalies should be investigated. (Action Clerk).

 

06/226 - PARISH COUNCIL LAND - TO RECEIVE PROGRESS REPORTS AND MAKE APPROPRIATE DECISIONS ON

 

(a)   Grass cutting

The grass has been cut.  It was hoped that it would not need to be cut again until the Spring.


 

(b)   Tenders for  pruning the willow tree overgrowing the Cartshed

The Councillors considered two quotations for pruning the willow tree and chose that from Ryland Horticulture.

 

(c)    Tenders for removing an ash tree

The Councillors considered two quotations for removing the ash tree on the Common Land and chose that from Ryland Horticulture.

 

(d)   Providing seats in the Moat Field

Keith Emerick of English Heritage has agreed in principle for boulders to be used as seats in the Moat Fields.  He suggests that the boulders have wooden slats embedded in them to make sitting more comfortable.  The Moat Fields trustees are meeting on 23 November when the proposed seats will be discussed.  Further discussion was deferred until the opinion of the Trustees is available.

 

(e)    Planting daffodil bulbs

Councillor Tomlinson had acquired 75kg of daffodil bulbs and he and the Clerk had planted them alongside the track down to the lido and along Main Street as far as Riversvale Drive.  Councillor Tomlinson and the Clerk were thanked for their work.

 

(f)     The proposed works to be undertaken in Church Lane by the Probation Service

The work has been delayed owing to a shortage of qualified supervisors.

 

(g)   Painting the Cartshed doors

This work has also been delayed owing to a shortage of qualified supervisors.

 

06/227 - TO RECEIVE A PROGRESS REPORT ON THE PARISH PLAN

A meeting is to be held at the Community Centre on 27 November when ten volunteers will meet to discuss the setting up of a working group.  Jo Buffey from the Yorkshire Rural Community Council will be attending.

 

06/228 - TO RECEIVE A REPORT ON VILLAGE POLICING

(a)      Special Constable Jerry Holland had produced a list of incidents in Poppleton which had been reported to the police in the 30 days to 20 November.  There had been 22 incidents in Nether Poppleton.  These were: four incidents of burglary to a business, two burglaries from sheds/garages, one theft of a vehicle, three other thefts, seven of criminal damage, three of nuisance youths/behaviour, one of a nuisance vehicle and one of disorder.   Much of the increase in incidents was attributable to problems on Mischief Night.

(b)     Councillor Powell reported that there had been complaints about a vagrant who had been living rough in Poppleton Park.  The vagrant had been joined by a lady friend for a while but now they have both moved elsewhere.

 

06/229 - TO AGREE THE CONTENT OF A PARISH NEWSLETTER

It was agreed that the following subjects would make good articles in the Newsletter.  The future of the Gardens Guild, the Wildlife Trust, daffodil planting, the Parish Plan, the Moat Fields seats and dog dirt.  Councillor Brown agreed to act as co-ordinator for the Newsletter and Councillor Bradley agreed to put the Newsletter together. (Action Cllrs Bradley and Brown).


 

06/230 - TO PROGRESS ARRANGEMENTS FOR THE OPEN DAY IN APRIL 2007

Arrangements are to be made to meet with the two nominees from Upper Poppleton Parish Council immediately after the Joint Parish Council meeting on 11 December.

 

06/231 - TO DISCUSS THE COMPLAINT REGARDING THE STATE OF THE FOOTPATH BETWEEN MAIN STREET AND RIVERSVALE DRIVE

It was reported that the footpath has several problems.  For much of the year nettles grow over the narrow path.  The slope at the Main Street end is dangerous in freezing weather.  Dog walkers throw their bags of dog dirt alongside the path.  It was agreed that the City Council be made aware of the problems.  The Councillors request that the path be widened, the verges cut on a more regular basis, a handrail be installed alongside the slope and a dog bin be installed somewhere along the path. (Action Clerk).

 

06/232 - TO DISCUSS THE PROBLEM WITH SPEEDING TRAFFIC IN OUSEMOOR LANE/COMMON CROFT LANE

A discussion was held following receipt of a letter complaining about the traffic which speeds down the back lanes.  It was agreed that the Parish Council has no power to prevent this happening but it was agreed that the Traffic Police be informed. (Action Clerk).

 

06/233 - TO CONSIDER A REQUEST FOR A ROAD SIGN TO INDICATE THE SEPARATION OF OUSEMOOR LANE AND COMMON CROFT LANE

It was agreed that a request for a road sign be referred to the City Council's Highways Department. (Action Clerk).

 

06/234 - TO SUPPORT THE COUNTRYSIDE ALLIANCE RE POST OFFICES

A request from the Countryside Alliance for support for rural Post Offices was discussed.  The Clerk advised the Councillors that Upper Poppleton Parish Council had just sent a strongly worded letter to Jim Fitzpatrick, the Parliamentary Under Secretary of State for Employment Relations and Postal Services at the Department of Trade and Industry.  It was agreed not to duplicate this letter but note that the Parish Council does support local Post Offices.

 

06/235 TO RECEIVE REPRESENTATIVES' REPORTS

(a)      Councillor Powell reported on the Rural West York Ward Committee meeting held on 18 October.  There was a presentation by Inspector Moreton on recent work done to combat anti-social behaviour and a discussion on Ward Committee schemes and suggestions for 2007-08.

 

(b)     Councillor Tomlinson reported on the Poppleton Community Trust AGM held on 24 October.

 

(c)      Councillor Robinson reported that he and Sid Ward had cleaned out the guttering on the Cartshed, washed and replaced the bird boxes and removed the Wildlife Trust sign for refurbishment.  Councillor Robinson also reported "As well as the doors of the Cartshed needing to be painted so does the guttering, downpipes and fascia boards.

"It was encouraging to discover that four of the six bird boxes had been used. One of the larger bird boxes had had its hole enlarged by woodpeckers and had not been used. Sid will fix. Another large bird box on the tree at the back of the Cartshed had fallen onto the ground. It had been used. There were no eggs or dead young inside so, hopefully, the box had been used successfully before falling. Sid has taken away to be repaired. I believe that the area can support more bird boxes and recommend that the Wildlife Trust purchase three more. If this is agreed then Sid and I will erect them onto suitable trees when we replace the bird box that is being repaired and the refurbished Wildlife Trust sign.

"We spotted a quite large goldfish in the pond. About 8 inches long. We saw no others but something large, almost certainly a fish, came up at the other side of the pond.

The other side of the pond, behind the horses stables which the BTCV did not clear because of the risk of asbestos, needs a good clear out both on the bank and in the water just below the bank".
