06/153 - DECLARATION OF INTEREST ON ANY MATTERS OF BUSINESS

Councillor Bradley declared a prejudicial interest in agenda item 06/159 regarding planning application 06/01529/FUL.

06/154 - TO RECEIVE APOLOGIES FOR ABSENCE

There were no apologies.

06/155 - TO CONFIRM THE MINUTES OF THE COUNCIL MEETING HELD ON 17 JULY 2006

The minutes of the Parish Council meeting held on 17 July 2006, having been circulated, were approved and signed.

06/156 - CLERK'S REPORT

  1. Progress on the Section 30 agreement for Broad Lane (Min. 06/139a)
  2. The Clerk reported that the Council Officer who deals with Section 30 claims is not at work at the moment so no action has been taken on this subject.

  3. Progress with altering the Cartshed doors (Min. 06/139b)

The bottoms of the Cartshed doors have been trimmed so that they open freely.

06/157 - TO CONSIDER CORRESPONDENCE RECEIVED BY THE CLERK

06/157/1 - The Clerk read or referred to the following correspondence

  1. A letter dated 2 August from Councillor Carol Partington giving notice of her resignation from the Parish Council with immediate effect. The Clerk was asked to write and thank Carol for the time and help she has given to the Parish Council over the last three years.

  1. A thank you for the donation letter from 3rd Poppleton Brownies
  2. A thank you for the donation letter from Poppleton Luncheon Club
  3. A thank you for the donation letter from PopSOC
  4. A questionnaire from Arup regarding the Lottery Fund grant for the Moat Field
  5. A questionnaire from the City Council regarding the recent planning seminar. Councillor Robinson completed the questionnaire

  1. To receive and approve the Accounts for the year ended 31 March 2006
  2. The Clerk reported that the auditor had returned the books and that there were no comments or observations about the books or accounts for the last year. The Clerk presented an Income and Expenditure Account for the year ended 31 March 2006, a Balance Sheet and a statement showing Section 137 payments. The Councillors accepted the accounts and agreed that the Chairman should sign them.

  3. To agree to sign a new bank mandate

All Councillors and the Clerk signed a new bank mandate.

06/159 TO CONSIDER THE FOLLOWING PLANNING APPLICATIONS

The Clerk had circulated a detailed list of current outstanding planning applications prior to the meeting.

*At this point in the agenda Councillor Bradley left the room.

 

Consideration was given to the following new applications:

Ref: 06/01529/FUL - Erection of 2 x 1.8m high double wooden gates at 4 Littlefield Close by Alison Jayne Bradley.

No objections

Ref: 06/01536/FUL - Single-storey extension to North side elevation. Pitched roof one and two-storey extension to South side elevation. Pitched roof double garage to front at 1 Poppleton Hall Gardens by Chris Swift & Sonia Snowden.

Objections on the following grounds.

  1. This is over-development of the original house which has previously been extended to the side and rear.
  2. The proposal is not in keeping with the way this estate was set out. It is contrary to the street scene. The proposal shows development in front of the suggested building line.
  3. It does not support the Conservation Area or give anything towards it.

The development is contrary to the Poppleton Village Design Statement.

Ref: 06/01587/FUL - Part two-storey, part single-storey pitched roof side/rear extension at 52 Allerton Drive by P Bootham.

No objections

*At this point in the agenda Councillor Bradley returned accompanied by Councillor Knowles.

It was noted that the Local Planning Authority had granted consent for the following two applications:

Ref: 06/00612/FUL - Erection of 5 no. warehouse/light industrial units at London Ebor Developments plc, Millfield Business Centre, Millfield Lane by London Ebor Developments plc.

Ref: 06/01378/FUL - Two-storey and first floor side extension at 48 Calder Avenue by Mr & Mrs K Taylor.

It was noted that the Local Planning Authority had refused the following application:

Ref: 06/01340/FUL - Two and three-storey side extensions and three pitched roof dormers to rear at 3 Church Lane by Mr & Mrs Mann.

It was noted that the following planning application had been withdrawn:

Ref: 06/01064/REMM - Reserved matters application for erection of 19 no. business units (B1 use class) pursuant to outline planning permission 05/02181 granted 12 October 2005 at York Business Park, Great North Way by Business Living Ltd.

 

06/160 - COMMON LAND - TO RECEIVE PROGRESS REPORTS AND MAKE APPROPRIATE DECISIONS ON

  1. Grass cutting
  2. It was reported that the grass on the Common Land has been cut as has the grass verge down Main Street but that a 30-metre strip near the triangle has been missed.

    The Clerk reported having been given the current figure that the City Council will pay for grass cutting. This is £8.29 per 1,000 square metres for verges and £21.00 per 1,000 square metres for areas such as the Common Land. Using these figures the Parish Council should expect to receive the sum of £1,111.

  3. To agree action on fallen branches obstructing the bridleway

The Chairman reported that a large branch had fallen out of an ash tree on the Common Land and was partly blocking the bridleway. Also that a branch that had fallen earlier in the year was lying near-by and the remaining part of the branch still on the tree needed to be made good. A quotation of £265 had been received from Ryland Horticulture. It was agreed that this should be accepted and that the branches should be removed.

  1. To receive a report from Councillor Bradley on the City Council's action on repairs to the road edge and verge

An audit of streets was undertaken by Cllr Bradley and the City of York Council SEO Andrew Williams and several issues including overgrown hedges (which are impeding wheelchair users), footway and carriageway defects were highlighted for action.

06/161 - TO RECEIVE A PROGRESS REPORT ON THE PARISH PLAN

06/162 - TO DISCUSS THE RESPONSE FROM THE CITY COUNCIL REGARDING A RISING BOLLARD AT LOW POPPLETON LANE

The Clerk reported having written to Bill Woolley, the City Council's Assistant Director (Development & Transport) and was waiting for a response.

06/163 - TO AGREE THE CONTENT OF A PARISH NEWSLETTER

Councillor Powell said he was still writing the Newsletter. Councillor Hook has agreed to format the Newsletter in the style of the current Upper Poppleton Parish Council Newsletters.

06/164 - TO CONSIDER A REPORT ON PROPOSED NEW PUBLIC FOOTPATHS

A letter received from the City Council about the proposed footpath/bridleway had been circulated prior to the meeting. After discussion it was resolved that Councillor Tomlinson would discuss the proposed route with Janet Hopton and that the Clerk would advise the Public Rights of Way Department that the City Council is the major landowner of the land over which the path will travel.

06/165 - TO NOTE THE PROVISION OF NEW STREET LIGHTS IN MILLFIELD LANE AND CONFIRM COUNCILLORS COMMENTS AND REQUIRED ACTION

Two new streetlights have been erected between Nursery Road and Hutton Close. It was considered that these are inappropriate for the location. It was resolved that the Clerk informs the City Council that the lights are inappropriate and that the Parish Council should be consulted before any alteration is made to street furniture. It was pointed out that the Ward Committee has paid for a streetlight survey for the whole of Rural West York Ward and that the Parish Council requests a copy of the report.

 

06/166 - TO AGREE TO THE REPLACEMENT OF DAMAGED LITTER BINS

It was agreed that the damaged litter bin by the Lord Nelson bus shelter and the missing litter bin opposite Millfield Gardens should be replaced by cylindrical bins. The Clerk was directed to write to the City Council accordingly.

06/167 - TO AGREE REALLOCATION OF REPRESENTATION ON OUTSIDE BODIES

With the resignation of Councillor Partington there is a vacancy on three outside bodies to which the Parish Council send a representative. It was agreed that Councillor Craven be the Parish Council observer on the Friends of Dodsworth Hall Committee and the Poppleton Moat Fields Management Group.

06/168 - TO CONSIDER THE PROVISION OF ADDITIONAL PUBLIC SEATS IN THE MOAT FIELD AND ON MILLFIELD LANE

It was agreed that the Councillors would visit the Moat Field to look for possible sites for seats and report back to the next meeting.

06/169 - TO CONSIDER MAKING "VILLAGE POLICING" A PERMANENT AGENDA ITEM

It was agreed to have "Village Policing" as a permanent agenda item. This will enable monthly reports to be made on the police presence in the village and any crimes that have been committed.

06/170 - TO CONSIDER THE NAMING OF THE NEW DEVELOPMENT AT NEW FARM ESTATE

The City Council had written to say that there was a proposal to name the new development at New Farm Estate "Mackenzie Court". After discussion it was agreed that "The Courtyard" would be more appropriate and that the City Council is to be advised accordingly.

06/171 - TO CONSIDER SUPPORTING THE WATCH YOUR SPEED CAMPAIGN

The City Council wants to ensure that everyone drives within the speed limit. To this effect it is introducing a Community Speed Watch Campaign. The Parish Council has been asked to support the Campaign, especially the implementation of having yellow and black stickers on wheelie bins with the words "It's our neighbourhood Watch your speed". The Councillors agreed to support the Campaign.

06/172 - TO CONSIDER NOMINATING A TRUSTEE FOR THE YRCC

There was no nomination.

06/173 TO RECEIVE REPRESENTATIVES' REPORTS

  1. Councillor Powell reported that there has been a lot of interest in the sale of Dodsworth Hall and that a decision will be made after 1 September.

  1. Councillor Tomlinson reported on the Community Trust meeting held on 1 August. Items discussed included:

  1. Councillor Knowles reported that work has started on the renovation of the Youth Club building.
  2. Councillor Robinson reported that there will be a Wildlife Trust working party on Tuesday 15 August. Two electric hedge trimmers have been bought.

06/174 TO RECEIVE THE CITY OF YORK COUNCILLORS' REPORTS

Councillor Bradley reported that the Ward Councillors will be meeting in September to consider Ward funding requests. The Parish Council will be advised and asked for its views.
