04/139 - TO CONFIRM MINUTES OF THE COUNCIL MEETING HELD ON 16 AUGUST

The minutes of the Parish Council meeting held on 16 August 2004, having been circulated, were approved and signed. The meeting in September 2004 had been abandoned is it was not quorate.

04/140 - MATTERS ARISING

  1. Access over common land - easement (Min. 04/126a)

It was reported that the Chairman and the Clerk had met with the Parish Council's solicitor, Graeme Burn who had advised that the Land Registry is close to accepting that the Parish Council is the owner of the Common Land. A detailed plan of the area had been drawn up showing the areas that were claimed by the Parish Council. The plan reflected the opinion of the City Council as to which areas they were responsible for and the owners of three pieces of land which could have been cause for dispute. The plan was shown to the Councillors who agreed that the Parish Council had no objections to the plan. It was agreed that Mr Burn should proceed to complete the registration.

  1. Mill Bank House easement (Min. 04/126b)

The easement for this property depends on proof of ownership of the Common Land. See the minute above.

  1. Access to shops from Montague Walk (Min. 04/126c)

It was agreed to defer discussion on this subject until the Spar extension is completed.

  1. Triangle seat (Min. 04/132)

The seat is now in place. It is made from recycled material and should be very hard wearing. It was reported that it is being well used by residents.

    The Clerk had circulated a detailed list of current outstanding planning applications prior to the meeting.

    Consideration was given to the following new applications:

    04/144 - COMMON LAND/ALLERTON DRIVE GARDEN -

    1. To receive progress reports on works in hand

    1. The hedge round the Allerton Drive garden was cut in August. It needs another cut to make it tidy. It was agreed that John Pannell should be asked to strim the grass in the garden again.
    2. The grass by the riverbank had been cut again in September. It was agreed that it should not be cut again this year.

    1. To agree action to be taken following a request to prune the trees in the area between Riversvale Drive and Riverside Walk

    Mr Ayres of Woodside had asked that the trees bordering his land be cut back. It was agreed that Dave Gregory of Ryland Horticulture be asked to survey the whole of the land between Riversvale Drive and Riverside Walk. This would complete the survey of the trees in the river end of the Common Land. Mr Gregory would be asked to comment on the state of the trees by Mr Ayres boundary as a matter of urgency.

    04/145 - TO DISCUSS GRASS CUTTING CONTRACTS FOR 2005-06

    It was agreed that the Clerk should draw up a detailed specification of the areas where the grass should be cut and the frequency of the cuts. This would form the basis of the tendering process. Four of five local grass-cutting contractors will be asked to submit a tender for the 2005-6 grass-cutting season.

    04/146 - TO DISCUSS SECTION 106 PAYMENTS

    It was agreed that the Parish Council has insufficient information on the village projects that could qualify to receive the balance of the Section 106 payments and that a decision should be deferred.

    04/147 - TO AGREE THE PARISH COUNCIL'S RESPONSE TO THE PROPOSED YOUTH SERVICE RESTRUCTURE

    The Councillors, having read the documentation about the proposed restructure of the Youth Service agreed that the Parish Council does not have an official position on the subject.

    04/148 - TO DISCUSS THE INCIDENCE OF HORSE FOULING ON FOOTPATHS AND CYCLE TRACKS

    The Councillors were advised of complaints received from residents about horse muck being dropped on the footpath and cycle track in Millfield Lane. The Councillors agreed that horses in the village enhance the rural environment. It was agreed that the Clerk should write a letter to the owners of the stables in Millfield Lane to ask them to tell horse riders to exercise horses on the grass and avoid footpaths and cycle tracks.

    04/149 - TO DISCUSS THE INCIDENCE OF OVERHANGING VEGETATION

    Several complaints had been received from residents about vegetation overhanging footpaths in the village and making walking difficult. The Councillors agreed that the Clerk should write to the owners of two houses where the problem was severe and ask them to cut their vegetation back.

    04/150 - TO CONSIDER THE PROPOSITION THAT THE NUMBER OF PARISH COUNCILLORS BE INCREASED FROM SEVEN TO NINE

    After discussion it was agreed that the Parish Council would not seek to increase the number of Parish Councillors for the time being.

    04/151 - TO RECEIVE REPRESENTATIVES REPORTS

    1. Councillor Tomlinson had been to the Open Day at Harewood Whin and had been impressed by the size of the site.
    2. Councillor Powell

    1. Gave a brief résumé of the proceedings at the Ward Committee meeting held on 14 October.
    2. Reported on the YLCA York Branch meeting of 7 October which was attended by 21 representatives from member Councils. Also present were Councillor Steve Galloway and Jonathan House from the City Council. Councillor Galloway spoke about the concerns of the City Council regarding the City but didn't say much about the rural areas. Heavy emphasis was placed on the £10 million shortfall in the Council's accounts. Branch business covered remuneration panel recommendations regarding allowances, parish review, Local Plan Stage 4. Licensing, delegated planning decisions and procedures. Meeting dates for 2005 were fixed as 3 February, 2 June and 6 October.

    04/152 - TO RECEIVE THE CITY OF YORK COUNCILLORS' REPORTS

    Councillor Hopton

    1. Congratulated Councillor Powell on being appointed as a Trustee of the Yorkshire Rural Community Council. Councillor Powell thanked Councillor Hopton and said that he had special responsibility for rural community buildings.
    2. Mentioned the Public Rights of Way to be held on Wednesday 13 October when possible footpath links between villages will be discussed.
